“So much for a second half recovery. Q3 is shaping up to be the quarter that wasn’t. Sounds like a lot of business is moving to the right. The question is how far to the right? The underlying technology dynamics remain solid but there is a lot of market fuzz surrounding it as we pointed out in our last report yesterday. Our concern is growing that Q4 also disappoint if things push too far. So far, everyone is adamant that Q4 will be good, however that's what everyone was saying about the second half of 2013 a few months ago.”

Mair also noted that “In a bizarre twist of fate, it seems the companies that are currently losing money are the ones guiding up,” and cited that the report from Axcelis Technologies was nearly on line with the $53 million projected earlier in the year.

The second quarter, while having a strong forecast, saw rather abysmal revenue considering.

Camera Stores and Electronics Shops That Purchased Flash Memory Devices Directly From SanDisk May Be Eligible for Class Action Lawsuit

The suit, filed in the U.S. District Court for the Northern District of California, alleges that SanDisk violated federal antitrust laws by fraudulently obtaining patents for flash memory technology used in memory cards for digital cameras, USB drives, and a variety of other types of electronic equipment.

According to the lawsuit, SanDisk obtained fraudulent patents by making false representations to the U.S. Patent and Trademark Office. SanDisk allegedly used these fraudulent patents to improperly exclude fair competition in the marketplace for flash memory devices.

The flash memory patent at issue in the lawsuit, which SanDisk allegedly referred to as the company’s “crown jewel” patent, allowed SanDisk to assert patent infringements on its competitors to prevent them from selling competing flash memory products, the suit claims.

As stated in the complaint, at least 75% of all NAND raw and finished flash products imported and sold in the United States is either manufactured and sold by SanDisk or manufactured through licenses of SanDisk patents. SanDisk allegedly charged its customers monopoly prices for flash memory products and threatened companies that purchased flash memory devices from its competitors.
